Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Maya Concierge website at mayaconcierge.bz, related booking and messaging services, and communications branded Point / Maya Concierge (collectively, the "Services"). The Services are operated by Point Realtor LLC ("Point," "we," "us," or "our").

By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Who we are

Maya Concierge is a tour and experience marketplace and concierge service focused on Belize. Point Realtor LLC provides the platform, payment facilitation (where applicable), and related customer support. Local tour operators and partners remain responsible for delivering the experiences you book.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account, complete a booking, or consent to SMS. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization.

3. The Services

Among other things, the Services may allow you to:

  • Browse tours, stays, events, and travel guides
  • Request itineraries or concierge help (including via WhatsApp or SMS)
  • Book experiences offered by independent local operators
  • Manage bookings and receive transactional updates

We may modify, suspend, or discontinue any part of the Services at any time. We do not guarantee uninterrupted availability.

4. Accounts and accurate information

You agree to provide accurate contact and booking information and to keep it current. You are responsible for activity under your account credentials and for safeguarding access to your email, phone, and messaging apps used with the Services.

5. Bookings, payments, and cancellations

Prices, availability, inclusions, and cancellation policies are shown at checkout or in confirmation messages and may vary by operator or product. When you book:

  • You enter a contract for the experience primarily with the listed operator (or with Point where we expressly sell a product ourselves).
  • Payment processing may be handled by Stripe or another payment processor; their terms also apply to payment collection.
  • Refunds, reschedules, and weather-related changes follow the cancellation terms disclosed for that booking unless required otherwise by law.

Platform fees, referral commissions, and operator payouts are internal commercial arrangements and do not expand your remedies beyond what is stated in the applicable booking terms and these Terms.

6. Operator and third-party content

Listings, photos, schedules, and safety practices are provided by operators or other third parties. We take reasonable steps to vet partners, but we do not control day-of operations, weather, marine conditions, transportation, or third-party websites linked from the Services. Your use of third-party services is at your own risk and subject to their terms.

7. Acceptable use

You agree not to:

  • Violate any law or third-party right
  • Scrape, abuse, or overload the Services
  • Submit false bookings, fraudulent payment info, or spam
  • Interfere with security, authentication, or other users' access
  • Use the Services to send unsolicited commercial messages without a lawful basis

We may suspend or terminate access for suspected abuse, non-payment, or risk to guests, operators, or the platform.

8. SMS, WhatsApp, and other messaging

If you provide a phone number or opt in to texts, messaging is governed by these Terms, our Privacy Policy, and the SMS Program / Consent disclosure. Message frequency varies. Message and data rates may apply. Reply STOP to opt out of SMS; reply HELP for help. Consent to SMS is not a condition of purchase.

9. Intellectual property

The Maya Concierge name, Point branding, site design, software, and original content are owned by Point Realtor LLC or its licensors. You may not copy, reverse engineer, or exploit the Services except as allowed by these Terms or applicable law. Operator-supplied content remains subject to the rights of its owners.

10. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, POINT DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Travel involves inherent risks. You are responsible for assessing fitness, insurance, visas, vaccinations, and local conditions.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POINT REALTOR LLC AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES OR ANY BOOKING. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO POINT FOR THE TRANSACTION GIVING RISE TO THE CLAIM IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) USD $100. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES, OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED.

12. Indemnity

You agree to indemnify and hold harmless Point Realtor LLC from claims, losses, and expenses (including reasonable attorneys' fees) arising from your misuse of the Services, your breach of these Terms, or your violation of law or third-party rights.

13. Privacy

Our collection and use of personal information is described in the Privacy Policy.

14. Changes

We may update these Terms by posting a revised version on this page with an updated effective date. Continued use after changes become effective constitutes acceptance of the revised Terms, except where additional consent is required by law (for example, for certain messaging programs).

15. Governing law

These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law rules, unless mandatory consumer protections in your place of residence provide otherwise. Courts located in Florida will have exclusive jurisdiction over disputes arising from these Terms, subject to those mandatory protections.
